1. Introduction

Welcome to ThinkerBot, an AI-enabled professional learning tool for educators. These Terms of Service (“Terms”) govern your use of ThinkerBot, a platform developed by Thinkering Collective and operated through Thinkering Labs.

By accessing or using the platform, you agree to be bound by these Terms. If you do not agree, you may not use the service.

2. Description of Service

ThinkerBot provides AI-powered, text-based tools that support educational activities such as instructional planning, curriculum development, and educator reflection. ThinkerBot is offered as a digital service under contracts or pilot programs with schools and districts.

3. Eligibility

To use ThinkerBot, you must be:

  • At least 18 years old

  • An educator, administrator, or authorized staff member from a recognized institution

  • Using the platform for educational and non-commercial purposes

Student use is not permitted without a district-managed integration and express consent.

4. Account Responsibilities

If access is provided via SSO, district login, or direct invitation, you are responsible for maintaining the confidentiality of your login credentials and for all activity under your account.

You agree not to impersonate others or misrepresent your affiliation with any institution.

5. Acceptable Use

Users may not:

  • Submit content that is discriminatory, defamatory, harassing, or harmful

  • Use the service for political, commercial, or unethical purposes

  • Attempt to reverse engineer or copy the platform

  • Interfere with other users or the integrity of the system

Violation of these terms may result in suspension or termination without notice.

6. User Content

Prompts and submissions entered by users remain the intellectual property of the user. Output generated by ThinkerBot can be used freely by educators for professional purposes.

We do not claim ownership of user-submitted prompts or outputs, but we may use anonymized versions to improve the platform and its underlying models.

7. Third-Party Tools

ThinkerBot integrates with secure third-party AI platforms such as OpenAI. Your use of the service implies agreement to those platforms’ terms, which are designed to comply with FERPA and related laws.

We do not control third-party services and are not responsible for their actions.

8. Termination

We may suspend or terminate your access if:

  • You violate these Terms

  • Your school or district ends its partnership or contract

  • You misuse the platform or attempt unauthorized access

9. Disclaimers

ThinkerBot is an AI-powered tool. Content is generated algorithmically and may occasionally contain errors or bias. We do not guarantee the factual accuracy or appropriateness of AI-generated responses.

You agree to review and vet content before using it in your professional work.

10. Limitation of Liability

Thinkering Collective, Thinkering Labs, and Thinkering Media are not liable for:

  • Errors or omissions in content

  • Service downtime

  • Data loss

  • Indirect, incidental, or consequential damages

Our liability in any matter related to ThinkerBot will not exceed the amount paid by your district for the service.

11. Governing Law

These Terms are governed by the laws of the State of New York. Any dispute shall be resolved in the appropriate courts within New York.
